KITTEN PURCHASE AND SALE AGREEMENT

2. CONSIDERATION & DEPOSIT The total Purchase Price is $_____________. A non-refundable deposit of $500.00 has been paid to hold the Kitten. The remaining balance of $___________ shall be paid in Cash or Certified Funds upon transfer of possession.

SECTION 3(A): MANDATORY BASELINE VETERINARY EXAMINATION: The Buyer is strongly advised and required to have the Kitten examined by a licensed Veterinarian within 72 business hours of taking possession.
The Seller shall provide a signed Veterinary Health Certificate upon the transfer of possession. This document must verify that the Kitten is free of contagious disease, parasites, and visible injury at the moment of departure.
Buyer shall have the Kitten examined by a licensed Veterinarian within 72 business hours of taking possession. This exam serves as the definitive record of the Kitten's health at the time of transfer.
Completion of this examination is a condition precedent to the 1-Year Congenital Warranty. Buyer agrees to retain the veterinary record of this visit as proof of compliance.
If the Kitten is found healthy at the 72-hour exam, any illness discovered thereafter shall be considered environmental and the Buyer's responsibility. This shall not apply to the specific congenital conditions (HCM/PKD) covered under the 1-Year Warranty in Section 3(B).
SECTION 3(B): 1-Year Congenital Warranty
In the event the Kitten is diagnosed with a life-altering congenital disease, limited to HCM (hypertrophic cardiomyopathy) and PKD (polycystic kidney disease) or expires as a result of such disease within the warranty period, the following mandatory protocol shall apply:
Notice Requirement: Seller must be notified in writing within forty-eight (48) hours of the initial diagnosis or death. Failure to provide timely notice constitutes a waiver of all warranty claims.
Condition of Replacement: If the Kitten is euthanized or dies, a professional necropsy must be performed by a licensed pathologist. To qualify for a replacement, Buyer must submit a written diagnostic report from the lab specifically identifying the cause of death as a congenital defect. This report must explicitly reference the Kitten’s pedigree name, DOB, color, and microchip number.
Exclusive Remedy: Buyer’s sole and exclusive remedy is a replacement Kitten of like kind and equal value. Under no circumstances shall the Seller be liable for a cash refund of the Purchase Price or Deposit.
Grace Period for Replacement: Seller shall have a twelve (12) month grace period from the date of the approved claim to provide a replacement kitten, subject to availability and breeding cycles.
Waiver of Claim: If the Buyer declines a replacement kitten offered by the Seller, or fails to request a replacement within thirty (30) days of the diagnostic findings, the Seller’s obligations under this warranty are deemed fully satisfied and discharged.
4. DECLAWING BAN & MANDATORY SPAY/NEUTER
Spay/Neuter: This kitten is sold as a pet only. Buyer agrees to spay/neuter the kitten between 6 and 9 months of age. Registration papers (TICA/MFA/WCF) will be withheld until Seller receives electronic verification from the attending Veterinarian with corresponding DOB, Pedigree name, Microchip ID#, and color of the kitten.
Declawing: Declawing is strictly prohibited. The Buyer acknowledges that this is a surgical mutilation that causes permanent physical and psychological harm to the animal. Regardless of local legality, any act of declawing constitutes a material breach of this Agreement.
Buyer agrees that the Spay/Neuter and Declawing clauses are "Essential Terms." If Buyer violates any obligation in Section 4:
All health guarantees and breeder support are immediately Null and Void.
Seller shall have no obligation to provide TICA/MFA/WCF registration.
Buyer shall be responsible for all of Seller’s attorney fees and court costs arising from the breach.
5. TRANSFER OF OWNERSHIP & WELFARE
Buyer agrees the Kitten will live strictly indoors.
Buyer shall not sell, lease, or trade the Kitten to any pet store, laboratory, or animal shelter.
If Buyer can no longer keep the Kitten, Buyer must notify Seller. Seller will assist in rehoming but will not accept a return of the Kitten. Buyer understands no refund will be issued for rehoming after the 15-day allergy period.
6. ALLERGY RETURN POLICY Seller offers a specific 15-day return window for severe allergic reactions. If the Kitten is returned within 15 days due to documented allergies, the Purchase Price minus the $500 deposit will be refunded.
7. SHIPPING & TRANSFER OF RISK
Point of Sale: This sale is finalized in Pike County, Pennsylvania. Any meeting at the Seller’s New York office, or personal delivery by the Seller to the Buyer’s location, is a courtesy delivery.
Personal Delivery: When the Seller personally delivers the Kitten, the Buyer must inspect the Kitten upon arrival. By taking possession, the Buyer acknowledges the Kitten is alert, healthy, and free of visible injury.
Medical Costs: Once the Kitten is handed to the Buyer, the Buyer assumes 100% responsibility for all veterinary medical costs. The Seller is not a health insurance provider and will not reimburse for any medical bills incurred after the transfer of possession.
The mandatory 72-hour veterinary examination window begins the moment the Kitten is in the Buyer’s possession.
8. GOVERNING LAW & VENUE
Governing Law: This Agreement is governed strictly by Pennsylvania Law.
Exclusive Venue: Any legal action, dispute, or small claims case arising from this contract must be filed exclusively in the courts of Pike County, Pennsylvania. The Buyer explicitly waives the right to file any action in New York or any other state.
8. ENTIRE AGREEMENT: This document represents the entire agreement. No oral promises are valid. If any part of this contract is found unenforceable by court, the remainder shall remain in full force.
